§1
General Provisions

  1. The online store [hereinafter “Store”] conducts retail sales via the Internet, based on these Terms and Conditions [hereinafter “Terms”].
  2. The owner of the Store is: BICEPSSHOP.NL located in Tilburg 5025 JK, Netherlands, Korvelseweg 114
  3. The Terms are an integral part of the sales agreement concluded with the Customer.
  4. Acceptance of the Terms by the Customer is a condition for concluding a sales agreement.
  5. The prices stated in the Store are gross prices in EURO (including VAT – BTW).
  6. The goods available in the Store are free from physical and legal defects.

§2
Orders

  1. Orders can be placed in the following ways:
    1. via the form available on the Store’s website,
    2. by email to the address available on the Store’s website,
    3. by phone at the numbers provided for placing orders, available on the Store’s website under the Contact tab.
  2. The condition for processing an order is providing by the Customer data allowing for the verification of the Customer and the recipient of the goods. The Store confirms the acceptance of the order by email or by phone. The Store has the right to refuse to accept an order, limit the payment method, or request prepayment if the order raises justified doubts as to the accuracy and reliability of the provided data or the method of payment.
  3. To place an order, you must:
    1. log in to the Store (optional);
    2. select the Product that is the subject of the Order, and then click the “Add to cart” button
    3. log in or use the option to place an order without registration;
    4. if the option to place an order without registration is chosen – fill in the order form by entering the recipient’s data and address for delivery of the Product, choose the type of shipment (method of delivering the Product), enter invoice details if they are different from the recipient’s data,
    5. the Customer has the option to choose the flavor of the supplement by clicking the appropriate button on the product page.
    6. click the “Order and pay” button/ click the “Order and pay” button and perform any additional steps necessary to confirm the order,
    7. select one of the available payment methods and, depending on the payment method, pay for the order within the specified period.
  4. The information contained on the Store’s website at the time of placing the order is binding, in particular: the price, the characteristics of the goods, their features, elements included in the set, delivery time, and method.
  5. The information on the Store’s website does not constitute an offer within the meaning of the Civil Code. By placing an order, the Customer makes an offer to purchase a specific product. The sales agreement is concluded when the Customer confirms the Order by clicking on the confirmation link in the email sent to the Customer by the Store.
  6. Customers taking advantage of promotions in the store may not use discount codes they possess. If the Customer enters a discount code for products on promotion, and the system calculates the discount, it is contrary to the Terms, and in such a case, the price the Customer must pay is the product price minus the promotional percentage, depending on the specific promotion. Promotional products may not be combined in any way with discount codes unless the Store decides otherwise for a specific promotion.
  7. Percentage discounts on individual purchases cannot be combined with percentage discounts on total purchases, which means that if you buy for an amount x, for which a discount of x% applies, this cannot be combined with a percentage discount on an individual product of x%, unless the Store decides otherwise for a specific promotion.

§3
Payments

  1. The Customer has the following payment options:
    1. cash on delivery – in this case, payment is made in cash upon receipt of the goods,
    2. bank transfer to the bank account number for foreign transfers:

      • BIC: INGBNL2A
        – in this case, the Store reserves the goods in the warehouse and sends them to the address specified by the Customer after the payment is credited to the bank account indicated for this purpose on the Store’s website or in an email to the Customer,

        WE ASK ALL CUSTOMERS MAKING PREPAYMENTS FOR THE ORDERED PRODUCT TO INCLUDE THE ORDER NUMBER IN THE TRANSFER TITLE.
        THIS WILL ALLOW US TO IDENTIFY THE PAYMENT QUICKLY
    3. payment by bank card – Visa, Visa Electron, MasterCard, Maestro
    4. via the online payment system – Klarna – according to the terms of the system provider,
    5. in another way, if specified on the Store’s website.
  2. The shipping costs are specified in the delivery rate.
  3. The condition for sending the goods is payment for the goods and shipping.

§4
Shipping of goods

  1. The ordered goods are sent by the Store through shipping companies or made available for collection by the customer at the company’s headquarters.
  2. Shipment of goods is possible within the NETHERLANDS, BELGIUM, and GERMANY.
  3. In the case of payment by a method other than online and cash on delivery, the shipping period is extended by the period between placing the order and the date of posting the payment to the Store’s bank account.
  4. The Store is not responsible for delays in the delivery of goods on the part of the companies.

§5
Complaints

  1. The basis for accepting a complaint is the Customer’s presentation of proof of purchase of the goods (fiscal receipt or VAT invoice).
  2. In the event of non-compliance of the goods with the agreement, the Customer should return the advertised goods to the Store along with a description of the non-compliance.
  3. The Store responds to the Customer’s complaint within 14 business days from the return of the goods along with a description of the non-compliance. If verifying non-compliance requires obtaining the opinion of an expert or representative of the manufacturer of the goods, the deadline for the Store to respond is extended by the time it takes for the Store to obtain such an opinion.
  4. If the implementation of a justified complaint involves sending the Customer a new product or removing non-compliance, the shipping costs are borne by the Store.
  5. Individual computer and monitor settings causing incorrect or distorted display of information about the goods (e.g., colors) cannot be the basis for a complaint.

§6
Right of withdrawal from the contract

  1. In accordance with applicable regulations, within 14 calendar days from the date of delivery of the ordered goods, you have the right to return it without giving a reason within the framework of withdrawing from the contract, according to the general rules arising from the regulations on distance contracts. This applies only to consumer sales, and therefore applies only to sales to a natural person who makes a purchase for professional or business activity.
  2. The returned product must not show signs of use – each element must be complete and factory packed, the product must be delivered in its original packaging in an unchanged condition. If this condition is not met, the product will not be accepted.
  3. If you want to return a product:
    1. Return the purchased product in an undamaged condition and in its original packaging along with all its contents. The shipment is made at your expense.
    2. Include in the shipment a written declaration according to the template attached to your invoice (http://www.federacja-konsumentow.org.pl/n,45,865,12,1,wzor-oswiadczenia-o-odstapieniu-od-umowy-zawartej-na-odleglosc.html), in which you express the desire to return the product, as well as the bank account number to which the refund will be transferred.
    3. Within 3 business days of receiving your shipment, we will check the condition of the delivered product (whether it shows signs of use, whether it has been damaged or destroyed, whether it is in its original packaging with all its contents).
    4. If we do not note any objections, we will send you an email confirming the positive consideration of the product return. The refund will be made to the attached bank account within 7 days. In the case of payment by credit card, the refund will be made to the card.
    5. If your product return is rejected (due to product damage or signs of use), we will send you an email informing you that the product return has not been accepted. Within 7 business days, we will return the product to the return address provided, covering the shipping cost.
  4. The right of withdrawal does not apply to the Customer in cases specified in art. 10 sec. 3 of the Act specified in sec. 1 above, i.e. in the scope of:
    1. services commenced, with the consent of the Customer, before the expiry of the withdrawal period from the contract (applies to cases of service provision, not sale of goods),
    2. audio and visual recordings as well as recorded on IT data carriers after the Customer has removed their original packaging,
    3. agreements concerning services for which the price or remuneration depends solely on price movements in the financial market,
    4. services with properties specified by the Customer in the order placed by him or strictly related to his person,
    5. services that, due to their nature, cannot be returned or whose subject matter deteriorates rapidly,
    6. newspaper delivery,
    7. gambling services.

§7
Privacy Protection

  1. The Administrator of Personal Data of Users of the BICEPSSHOP.NL online store is Bicepsshop, Tilburg 5025 JK, Holland, Korvelseweg 114, VAT (NIP): NL002459414B68, Chamber of Commerce (REGON): 71129219.
  2. The store processes customers’ personal data in accordance with the rules specified in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation), national laws, and national implementing acts, while adhering to the data protection procedures described in these legal acts.
  3. Detailed rules for the processing of personal data by the store and the rights of customers in the field of data protection are defined in the Privacy Policy.
  4. Before creating a user account or making a purchase, the customer is obliged to familiarize themselves with the rules of personal data processing applied by the store, and in particular with the rights resulting from them. A statement confirming familiarity with the rules of personal data processing is required for proper registration and authentication of the customer in the store.

§8
Intellectual Property

Any use of materials published on the website of the Store (including images and product descriptions) without the written consent of the Store is prohibited.

§9
Entry into Force and Amendments to the Regulations

  1. The Regulations come into force upon publication on the website of the Store.
  2. The Store reserves the right to make changes to the Regulations.
